Penalties for Repeat DUI Convictions

- Under .10, you are facing a $2,100 to $5,000 fine and five days to one year in jail
- Between .10 and .16, you are facing a $2,500 to $5,500 fine and 30 days to two years in jail
- Over .16, you are facing a $3,500 to $6,500 fine and 90 days to three years in jail
If you are found guilty of a third DUI offense and your BAC level is:
- Under .10, you could be fined $3,800 to $6,300 and receive 60 days to three years in jail
- Between .10 and .16, you could be fined $5,000 to $7,500 and receive 90 days to four years in jail
- Over .16, you could be fined $7,500 to $10,000 and receive six months to five years in jail
In addition to these enhanced penalties and fines, the administrative penalties increase, with additional fees, longer driver's license suspension times, required alcohol counseling, additional mandatory insurance coverage (SR-22) and possibly even the installation of an interlock ignition device.
